Terms of Service
1. Agreement to Terms
These Terms of Service ("Terms") are a legal agreement between you and MALCOMSON BROTHERS LIMITED ("we," "us," or "our") for your use of talgia, including our mobile apps, websites, camera tools, templates, recaps, sharing features, subscriptions, and related services (the "Service").
These Terms apply wherever you access the Service, including iOS, web, or any other platform where the Service is available. Some features may only be available on certain platforms.
By using the Service, you agree to these Terms. If you do not agree, do not use the Service. You must be at least 13 years old, or older if your country requires a higher minimum age. If you use the Service for someone else, you confirm you have authority to do so.
2. What talgia Does
talgia helps you create, edit, save, and share stylised photos and videos. Features may include:
- Camera presets, filters, stickers, backgrounds, adjustments, and look codes
- Local photo history, local rolls, saved custom cameras, and on-device exports
- Recaps, video exports, before/after artifacts, and social sharing formats
- Templates and collage-style photo placements
- Shared rolls, shared camera invites, replies, reporting, and moderation tools
- AI-assisted or AI-generated photo features where available
- Paid subscriptions, premium templates, premium camera looks, and other paid features
Some features work locally on your device. Others require uploads, account access, online storage, or sharing links. We may add, change, limit, or remove features as the Service evolves.
3. Accounts, App Installs, and Security
- You are responsible for activity under your account, device install, shared links, and credentials.
- You must provide accurate information and keep your account secure.
- You may use anonymous/local features where available, but account-backed features may require Sign in with Apple, email login, or web account linking.
- You must not attempt to access another person's account, content, shared roll, or payment entitlements without permission.
- We may suspend, restrict, or terminate access if we reasonably believe there is fraud, abuse, security risk, policy violation, non-payment, or legal risk.
4. Your Content and Creative Outputs
4.1 Ownership
You keep ownership of photos, videos, captions, stickers, templates, and other content you upload or create ("User Content"). Subject to these Terms and applicable law, you may use photos, videos, recaps, edits, and other outputs you create through the Service ("Outputs") for personal or commercial purposes.
4.2 Licence to Operate the Service
You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, process, modify, display, transmit, back up, and otherwise use User Content and Outputs only as needed to provide, secure, improve, support, moderate, and legally operate the Service. This includes generating edits, templates, recaps, share artifacts, look codes, invite links, thumbnails, previews, and support, safety, or moderation views.
4.3 Sharing
If you create a shared roll, look code, recap, template session, invite link, or social artifact, you are choosing to make that content available to the people who can access that link, destination, or collaboration space. You are responsible for only sharing content you have the right to share.
4.4 AI and Generated Results
AI-assisted results may be imperfect, unexpected, inaccurate, non-exclusive, or similar to outputs created for others. You are responsible for reviewing Outputs before using or sharing them.
5. Content Rules
You agree not to upload, create, share, invite others to, or use the Service for content or conduct that:
- Violates law or another person's rights, including privacy, publicity, copyright, trademark, or contractual rights
- Uses someone else's image without any required consent
- Involves sexual, exploitative, abusive, or unsafe content involving minors
- Harasses, threatens, defames, impersonates, or targets another person
- Promotes violence, hate, self-harm, fraud, spam, or illegal activity
- Contains malware, attempts to bypass security, or interferes with the Service
- Attempts to scrape, resell, reverse engineer, overload, or misuse the Service
Our Acceptable Use Policy also applies. We may remove content, hide shared media, restrict sharing, suspend accounts, or report activity where appropriate.
6. Shared Rolls, Reports, and Moderation
- Shared rolls and invite links are designed for private or semi-private sharing, but anyone with access to a link may be able to view or contribute depending on the feature settings.
- Roll creators and contributors are responsible for the content they add and the people they invite.
- We may set limits on shared rolls, replies, uploads, storage, expiry, retention, and contribution states.
- Users may report shared content where reporting tools are available.
- We may hide, delete, preserve, review, or disclose content when needed for moderation, safety, legal compliance, fraud prevention, or support.
7. Payments, Subscriptions, and Entitlements
- Some features require payment, credits, a subscription, or an active entitlement.
- iOS subscriptions and in-app purchases are handled through Apple's in-app purchase system and are subject to Apple's terms, billing, cancellation, renewal, and refund processes.
- Web payments, where available, may be handled by Stripe and are subject to Stripe's payment processing terms.
- Subscriptions renew automatically unless cancelled through the relevant platform before renewal. Cancelling a subscription stops future renewals, but does not necessarily refund the current billing period unless the relevant platform or payment provider approves a refund.
- For Apple purchases, you can manage or cancel subscriptions through your Apple ID or App Store account settings. For web purchases, use the account or billing tools we provide where available, or contact us for help.
- Entitlements may be linked between iOS and web accounts where you connect the same account or use an account-linking flow.
- We may change pricing, features, limits, and available products prospectively, subject to applicable law and platform rules.
- Refunds are handled according to applicable law and the platform or payment provider used for the purchase.
8. Our Intellectual Property
The Service, including software, designs, camera presets, filters, effects, templates, branding, logos, copy, interfaces, and technology, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service as allowed by these Terms.
If you send us feedback or suggestions, we may use them without restriction or payment to you.
9. Privacy and Data
Your use of the Service is also governed by our Privacy Policy, which explains what we collect, what stays local, what is uploaded, how sharing works, and how account deletion is handled.
10. Account Deletion and Content Removal
You may request account deletion through the Service where available or by contacting us. Account deletion removes access and deletes or anonymises associated account data, subject to records we must retain for billing, accounting, fraud prevention, safety, dispute resolution, legal obligations, or platform compliance.
Removing an app from your device may delete local-only content stored by the app, but it may not delete online content, shared links, purchase records, or backups. Use in-app deletion tools or contact us for online data requests.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not promise that the Service will be uninterrupted, error-free, secure, available forever, compatible with every device, or that every edit, filter, recap, template, AI result, or share artifact will meet your expectations.
Nothing in these Terms excludes rights or warranties that cannot be excluded under applicable consumer law.
12. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages; loss of profits, goodwill, data, or business; service interruption; unauthorised access; or content created, uploaded, shared, or received through the Service.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or GBP 100 if you have not paid us.
13. Indemnity
You agree to indemnify and hold us harmless from claims, losses, liabilities, damages, costs, and expenses arising from your User Content, Outputs, shared links, invitations, use of the Service, violation of these Terms, violation of law, or violation of another person's rights.
14. Changes, Suspension, and Termination
- We may update the Service, change feature availability, or set limits for operational, legal, safety, or product reasons.
- We may suspend or terminate access if you violate these Terms, create risk, fail to pay, misuse the Service, or if required by law or platform rules.
- We may update these Terms. We will update the date above and provide additional notice for material changes where appropriate.
- Your continued use after updated Terms become effective means you accept the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any dispute will first be discussed in good faith. If not resolved, disputes will be subject to the courts of England and Wales, except where applicable consumer law gives you mandatory rights in your country of residence.
16. General Terms
- These Terms, the Privacy Policy, and the Acceptable Use Policy form the agreement between you and us.
- If part of these Terms is unenforceable, the rest remains in effect.
- Our failure to enforce a term does not waive our right to enforce it later.
- You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, restructuring, sale of assets, or by operation of law.
- We are not responsible for failure or delay caused by events outside our reasonable control.

These Terms of Service are effective as of June 20th, 2026 and supersede all previous versions. By using talgia, you acknowledge that you have read, understood, and agree to be bound by these Terms.
